The case took place on May 17 , when the woman was traveling along BR-386 in Lajeado, in the Taquari Valley. The investigations pointed out that the defendant tried to commit suicide and murder her daughter, walking in the opposite direction of the road, with the aim of getting revenge for her ex-husband's betrayal.
The motivation was considered an aggravating factor by Judge Carmem Rosa when defining the sentence. “Attempting against her own daughter's life, in response to the abusive and unfaithful behavior of her ex-partner, then the victim's father, was behavior that was absolutely incompatible with the legal and moral duty of support and protection inherent to motherhood, imposing greater censorship recognition. in the conduct of the accused”, said the magistrate in the sentence that established the penalty for attempted qualified murder.
The judge also understood that the defendant "had full capacity to understand the illicit nature of the conduct". Another aspect highlighted in the sentence as an aggravating factor was a video posted by the woman on social media. Moments before the accident, she recorded a video in which she asked that the daughter, who was in the car seat in the back seat of the car, said goodbye to her father. Shortly after, the car collided with a truck, which completely destroyed the vehicle. However, neither of them died in the accident.
In the video, she says to her daughter: "Are we going to kill ourselves?", and the child, who at the time was two and 10 months old, replies: "No". The woman's preventive detention was decreed on May 21, a few days after the accident, and maintained by the judge of first instance. The defendant can still appeal the sentence in other instances.
The accident
On May 17, around 2:20 pm, the Fiat Uno with Cruzeiro do Sul plates collided with a Mercedes-Benz belonging to Anta Gorda. According to witnesses, the Fiat Uno suddenly invaded the opposite lane. A Hyundai Tucson was also involved in the accident.
The Uno driver was trapped in the wreckage and had to be removed with the help of the Fire Department. With several injuries and trauma to her body, including her head, she was sent to Bruno Born Hospital, in Lajeado, and later transferred to the Canoas Emergency Hospital (HPS).
Her daughter, a 2-year-old girl, was pulled from the vehicle by witnesses with minor injuries.
